Cops Shoot Latino Marine 71 Times, Deny Him Care In Arizona

An Arizona SWAT team shot 26 year-old José Guerena, 26, 71 times, wounding him about 60, as they executed a search warrant on his home. The former Marine who served two tours in Iraq was killed when he saw men with guns advancing on his home. Police accidentally shot a gun; the resulting confusion lead to Guerena bleeding out and dying in his own home. Police refused to allow medical personnel in to help save his life. The Daily Mail reported:

An ambulance reportedly arrived in a few minutes, but medical personnel were not allowed inside to see Mr Guerena for an hour and 14 minutes, the family’s attorney, Chris Scileppi, told ABC News affiliate KGUN.

Police involved in the Tucson SWAT raid in the neighborhood, three other homes fell under the warrant, apparently did not identify themselves to anyone inside the home. The result is that Guerena, who managed to avoid being killed in Iraq, was killed in his own home after coming home from a 12-hour shift in a mine. The Arizona Daily Star reported:

Guerena’s role in the narcotics investigation is unclear and deputies would not comment on what was seized from his home…

Vanessa Guerena says she heard noise outside their home about 9 a.m. Thursday and woke her husband who had just gone to bed after working a 12-hour shift at the Asarco Mine, she said. There were no sirens or shouts of “police,” she said.

Guerena told his wife and son to hide inside a closet and he grabbed the AR-15 rifle, his wife said.

His wife insists there were no drugs in their home, and police have yet to prove otherwise. It gets even worse, as apparently the police were the ones who shot first, by accident:

Apparently one of the SWAT team’s deputies accidentally fired his gun, leading to confusion.

This is a pretty egregious case of police brutality and racial profiling, if you ask me. I can’t imagine the terror this poor woman and her son experienced, listening to her husband die, pleading for help, being ignored and treated like a criminal as he lay bleeding out on his own carpet.

    most of you people are Idiots Because they Had a search warrant and that means you don’t ring the doorbell so they can flush their stash also the guy had an AR-15 if you didn’t know is an assault rifle So I believe the police were justified in shooting but not just letting him die.  further more they don”t just waste their time getting search warrants for people with  misdemeanors.  I don’t think if he was supposedly shot 71 times he was going to survive even with medical attention,  but there should have been an attempt.

    This is NOT about Race. I attended the Service on Memorial Day with Jose’s widow and family.  OathKeepers came to Arizona to honor a fallen hero, though it was not either tour in Iraq where he died, but in his kitchen, face down, his brains showing.  I thought you Law Enforcement guys were taught to shoot in the leg or somewhere to incapacite the, ah, let’s see, Marine with a gun to protect his wife and son from home invaders, having been awakened by his wife saying men with guns are outside.  Jose was not a criminal, he did what he was trained to keep his safety on until he could figure out who the intruders were.  The SWAT team did not stop shooting.  Was this another assasination? No, it was trigger happy SWAT members, none from Tucson Police Department!! who never did their job.  They never did serve the search warrant.   This War on Some Drugs is a phoney, baloney lie and we all know that is why this man is dead.  END THE WAR ON DRUGS Stop SWAT from serving Search Warrants.
    The supposed sirens we hear on the tape sound like car alarms to me.  What do they sound like to YOU?

    Being shot 71 TIMES is NOT accidental.  Maybe once or twice but NOT 71 times!  Then denying him medical attention…NOT accidental.  We need to wake up.  This was an assassination, execution – call it what you want, but don’t call it murder.  That’s a light word if you ask me.

    This is truly a sad story. May God be with his family and their legal counsel as they begin to mend their lives and seek justice. Have faith in God that justice will be done for this family, but no monetary judgement can ever make this tragedy right!  To the family – you are in my prayers today.

    I have to agree with Djhightek2000 – I’m also en-raged how is it that THE SWAT TEAM and POLICE OFFICIALS wants to call this an ” ACCIDENT ” , an accident my foot. How do you shoot 71 rounds and kill the person with 60 and to make matters worst you deny the victim medical attention, how in-humane is that?  You don’t even treat a dog that way.  I too believe it was racial profiling, you rarely will hear a white person getting treated or killed in this way.  This was a young Hispanic man 26 years of age with a wife and child who served his country so you and I can have our freedom, yet gets killed by one of the same as he to SERVE AND PROTECT.  While in Iraq he took care of himself to make sure he came back safe and sound to his family, but than he comes back home and get’s killed how crazy is that?All those involved should be held accountable, from the head of the person in charge who gave the green light to carry out the orders to the last one who fired the last shot.  Regardless the reasons or motives they might of had for this raid, this was a human being not an animal and he didn’t deserve to be killed in this way and shot 71 times in his own home while his wife and child were there that’s pathetic. For these men to abuse their authority the way they did even under strict orders is unjustifiable, and someone has much explaining to do. My condolences to his entire family, I feel for his wife, his child who will never see his/her Daddy ever again, and his poor mother who lost her son,  not fighting for his country but rather lost him to the hands of a SWAT TEAM who called this an accident.  How can these men live with themselves after this, better yet how can they go home and see their family and still sleep at night with this on their conscious.

    What this is about is SWAT training that condones overwhelming force,  no knock-kick in the door with guns drawn and hair trigger reflex training.  Time this idiocy was REVERSED.  PERIOD.  FULL STOP.

    God bless you Jose’!  My thoughts and prayers go out to his family in their time of loss.  This is such a tragedy, when we are honoring our Military for their service and now the family has to have a funeral service for someone else negligence…So Sad…:-(

    This is amazing, it isn’t about race, it isn’t about a former soilder.  It is about a family teared apart.  A child witnessed his father being murdered.  A wife lost her husband and now has to deal with putting her family back together emotionally and financially.  All that wouldn’t have been an issue if procedure was followed properly.  So the police labels this as an accident.  If the person whom fired the first shot had a conscience(may have spelled wrong) he/she should have stood up and allowed medical treatment.  It was no accident that the ambulance wasn’t allowed, being that they made seveal attemps and was turned away.  This was deliberate.  If medical treatment was allowed, his life “may” have been saved.  If this gentleman was in the wrong then we would’ve had the JUSTICE system decide his fate.  Instead the Justice system failed him in all sense of the term.The sad thing about this story, This MAN stood to protect his country-was he called a Latino then?  He was called a soidier.  As first nature, he stood to protect his family as he was trained to do so for his country.  And his country betrayed him. Can you imagine the outcome if he didn’t tell his family to hide in the closet? Personally I have no respect for this group of officers whom had anything to do with this particular case.  I think they all should go to jail.  I also think the state of Arizona should take care of this family financially for their pain and suffering.  There is not amount of money that can replace or make up for their lost.  May GOD look over this family, and protect the fate of this child whom witnessed his father die in cold blood.

    This is a story of a unjustified homicide no matter is he was part of an “investigation”.  What saddens me the most is that he was a man who solidly fought and sacrificed for his country and he was brutally murdered by the ones who take an oath to protect and serve. This is a tragedy and I personally will be praying for his wife and child. May God be with them and hold their hearts in his hand and wipe their tears of pain away. Please like this comment if you believe that the Police force need to have more training. This happens everyday of officer involved shootings and it is sad. But if a suspect turns and kills an officer on duty they are killed or sentenced to years in prison, But if it is the other way around they get paid leave and after the “investigation” are usually let back on the job. What ever happened to innocent until proven guilty and isn’t  in the 10 commandments Thou shall not kill???!!!!!!! What makes The law enforcement an exception to that rule? WRONG IS WRONG!!!!!!!!  no matter who you are one day I know when the officers involved meet their maker they will be judged accordingly. May God have mercy on their souls!!!!!!!!!!

    What a misleading article. The cops did identify themselves, I saw the video, and everywhere on their uniforms and shields said cops. According to other reporst he picked up a semi-automatic. If you have a semi-automatic pointed at you wouldn’t you shoot. I think this is a travesty and  feel for his family but the cops aren’t the ones to blame for shooting, they did what they are trained to do.  They really need to look into getting their info right.

    Wow, nobody seems to care that they were executing a warrant to search the home. Another thing nobody seems to care about is he confronted an armed SWAT team with an assault rifle. Talk about training here…..the man did a tour in Iraq and did not notice the giant white letters on the from vests of the men entering the home that read POLICE. And the backs that said SWAT. I served my country, and now serve my city as an officer of the law. The training I have recievec from both would have prevented me from pulling an assault rifle on an incoming SWAT team. It’s not race thing, and it’s not a profile in any way. It’s a man, suspected of a crime, brandishing an assault rifle on officers of the law entering his home. I guess Osama Bin Laden was profiled.

    the fact that they reported his race is only to hype up this problem, the problem is that cops shot a man, and a freaking vet no less who just came back from serving his country, who only reacted to a gun shot the way he was trained.  charge the police with a homicide after firing their asses.  It doesn’t matter how sorry you are after the fact, if you’re going to go into a situation as a police officer trigger happy then you shouldn’t be on SWAT.  

    Guys get over this 1900′s racist mentality, you’re only ensuring that it continues when you assume everything that happens is out of racism, get the facts.  I know we still have a long way to go before things are fully equal but you’re only slowing it down.  

    i dont know where this Sara got her info from but looking at the different sources you can tell she’s added in quite a bit of fluff, it really sucks when people mix up facts with  perspective.  One thing is clear though, somebody screwed up big time and should face the consequences weather they think they did the right thing or not.

    When you put Race in the equation, you lose support. My Grand Father was from the origenal Latino Country. It’s not Mexico. It’s Itely where Latin was the langauge sopken. My daughter want’s nothing to do with the Latino’s of today because thay make  it all about race.

    This is not the only case of a Marine being murdered by the law. Marine Sergeant  Derek J. Hale was murdered in Wilmington, Delawre. In 2006.  Look it up. “Death Squad in Delaware: The Case of the Murdered Marine”.  LewRockwell.com.

       The sheriff LOCKS people up who just say they do NOT like him! I am from AZ , My family settled there in 1800s from Canada. We are ALL leaving! They ruined it!  In fact I would steer clear as it is a prison industrial complex, POLICE state, go somewhere else! Mexicans/Hispanics/Latinos/Chicanos etc. have Been a part of the southwest. The North American Native Indians were murdered and enslaved by so-called Christian haters! The race card doesn’t fly with me, as I am part Osage Canadian Indian and Scottish. These criminal corporations and banksters have economically ENSLAVED us all its an EQUAL opportunity enslavement!        Its NOT just a Latino issue! They blow whites away, I saw them blow a white dude away in SF, CA for wielding a knife with NO ONE around, they shot him NINE times. In SF they also shot a 18 year old kid saying he stole the car when it was his dad’s. He was so scared he accidently put the car in R instead of P and it rolled and hit one cop and broke his arm, the other cop blew the kid in the back of the head! The father sued! I say to the poor family of this young man SUE, SUE and SUE! As a AZ native… I hope the state goes BANKRUPT! I cannot tell you what they’ve done to my family! SUE! Not that all the money will replace Jose, but maybe they can open a non-profit to help other vets, or a foundation for other families that are victims of Ignorant gun toters!
       If we ALL fight each other they ( the ones enslaving us all and robbing us and our freedoms and rights… They WILL put us under Martial Law)! That is what they want!

    It’s sad but true looks like he was safe out there than his own house I just got back from a tour ad y suggestion is PLZ train ur swat team better even overseas we are train not to shoot upon hearing gun fire until we have positive ID but seems like Arizona needs some training. Soo sad the situation to hear a hero die that way but the real terrorist seem to be in our own country.

    When will we, as humans, treat each other as fellow humans?  I am 60 years old.  I am sick to the bottom of my soul at the way the “majority” treats “minorities”.  It covers race, class, money, religion, sex, (as in you have no right to your uterus or to what may be in there), or who you may love.  The vile hate that is thrown around is beyond my comprehension.  There is no hope until our children take over.  And, I am speaking as an old flower-child, hippy-dippy.  I am thankful every day that I have 3 children who can fix this crap.

    There were probably Latino cops on that Swat team. this isnt about race, more the fact they denied him medical care. doesnt matter who he was. If he did something wrong you could always handcuff him after the paramedics save his life. This was poorly handled. Man shouldnt have tried to go after a swat team with an AR-15 assault rifle though….

    OMG I hope you have a system where this will come under reveiw and if they are at fault, charge them all… they are quick to react, now make them accountable.  Particular investigation should go to as why  not medical assistance given access. After they shot him 60 times, my guess is he would not have been resisting anymore!!!

      How does this have anything to do with SB1070?  This involved drugs, not immigration.  Also, according to this article, the police were executing a warrant, which means their entering the home did not violate the Fourth Amendment.

    We don’t have all the pertinent information regarding this disaster but you have to wonder why a SWAT team was needed to execute a warrant on one man who could  easily have been apprehended by patrol officers while leaving his domicile???? If the issue was drugs inside the house why not enter and seize the contraband when no one is at home??? It is no accident that reckless disregard for human life never happens in Beverly Hills

    Okay, first and foremost, this is a horrendous occurrence and I think the police should be held accountable for murder!  That being said, a couple pieces of information I read (in an article from the Huffington Post) that were not included in this article.  (1) The warrants were issued for the four homes by ADDRESS ONLY.  Nowhere on the warrants were names of the homeowners or residents.  That would contradict racial profiling.  (2) The Huffington Post article also said that, after a search of the home, no illegal substances were found.  And, at least one other of the homes “attacked” had no illegal substances.  So, not only were the officers who shot him (60 rounds????) guilty of murder but whoever investigated and decided the homes should be raided is complicit in the murder.

      If he lived in a predominantly Latino neighborhood, yes that would indicate racial profiling because the warrants covered those addresses. BTW, how do you feel about the idea that if you live near anyone who is suspected of a crime, you could be shot 71 times without warning? Do you think that happens in gated communities?

    wow. This is horse sh*t. I am leaving on monday for yet ANOTHER tour over sea’s and now i see that the people here only care that he was Latino? Grow up. Its not about Race. Its the event that we are looking at here. You think there was NO Latino men on that SWAT team? This isn’t about race. It’s about the fact that a man who served his country was safer in Iraq then he was in his own home.

      It is about race when it is in racist Arizona. I definetly understand the concern of him being a soldier and he was probably safer in Iraq, but the location of his death and circumstances of not allowing him medical attention is more  paramount to me. The race part is just as significant due to the location.

            What are the laws in effect?  I ask that because I am seriously curious, not because I’m being sarcastic.  Further, I won’t deny that racism and xenophobia played a part in the law, but the fact is that it is an attempt to secure the borders when people are crossing them with impunity.  This includes innocent, hard-working people as well as a criminal element from the drug violence in Mexico.  I would like immigration reform so that people looking for work and who can contribute to our economy are allowed to cross, but ignoring the illegal border crossings allows criminals to remain in this country when they would otherwise be deported.  If a law like this existed in every state, at least one of the 9/11 hijackers likely would have been caught before he helped kill thousands.

        I agree with this poster… It is about race. This law enforcement organization (by statements in the report) was negligent in their actions. If this “suspect” had been caucasian, the search warrant would have been served by simply sending a clearly uniformed officer to ring the doorbell! This SWAT team had prior intelligence on their “suspect” and knew that he was a USMC & Hispanic. They chose to ignore his sacrafice and treat him like an “undocumented worker”.  My prayers to his family.

      Oh, but it is about race. You seldom hear a story about a Caucasian male being riddled with bullets, but every so often, in Brooklyn or Queens, NY where I’m from a young male of African decent is shot dead by police with a shocking number of rounds. The demographic of neighborhood in which the warrant was issued is significant as is the information that SWAT received prior to going into the home.
      And yes, there probably were Latinos on the SWAT team, as their are plenty of African American cops in NY, but this doesn’t change, quite literally the way that these situations look and the people who are caught up in them. You need to think about how oppression has transgressed boundaries of color; people who belong to the same “race” (it’s a bull term) have been indoctrinated into viewing things racially. An African American cop can be the aggressor against an African American teenager on his way home from school but I can almost guarantee you that an Asian child in that same district would be treated in like manner.
      I don’t have time to write a dissertation, but think about it. This non-sense about being post-racial, or not paying attention to how real race has become is a farce – be real with yourself. You see the world in terms of blacks, Latinos, whites, Asians, and Indians, and I’ll bet that you unconsciously presuppose bias judgements about these groups no matter how innocent you believe them to be.

    I agree that the S.W.A.T team should be held accountable for thier actions but I also agree with Arizonas stance on illeagal immagrants. If it wasn’t for all of the latino’s helping to bring thier friends and relatives here illeagally Arizona would not have had to make a stand and protect our border. I’m all for people coming to America for a better life but if you are going to do so do it with proper documentation and please learn the language. I wouldn’t expect to move to say Japan and have them all learn english and change product labeling so that it wouldn’t inconveinence me by having to learn Japanese. Get a clue people !!!!!!!!!

      First of all the latinos have been in AZ for far longer than any ‘white’ man out there. Spanish has been the language of Arizona and California since before any English speaker ever set foot there.

      Arizona is in the position of giving in to fear mongering and racism. You are the one who needs to get a clue. 

      That is not to say there isn’t a problem with the cartels, drug & gun trafficking along the border but this man was a UNITED STATES MARINE who was killed by the police in his own home and DENIED MEDICAL CARE.       So you blame the illegals too? The immigration problems are complex, and for the most part these complexities are played by the Powers That Be to their benefit. The illegals are pawns, the southwestern states and the citizens are pawns, everyone who has any association or has been impacted by immigration is nothing more than a place-holder to these people.

      We have agriculture jobs that admittedly, caucasians don’t want. The work is hard and the pay is low. They are not good employment material anyway because most caucasians who MIGHT take that job cannot speak Spanish. The work goes by default to Mexicans. There are warehouse jobs, landscaping jobs, roofing, and other physical labor jobs that are somewhat mixed racially. But it depends on the personal inclination of who’s doing the hiring. EVERYONE needs a job, and who can blame a poor Mexican family for crossing an artificial, political border to go find a job to support themselves?

      It isn’t that the Mexicans are coming for the benefits, either. The country to our south has national health care for all it’s citizens. The details of this care I couldn’t tell you; I don’t know. But who would walk away from a sure thing in health care to go somewhere that it is only given in extreme circumstances in the ER at a great cost? So to say that the Mexicans are burdening the system would be wrong. That’s one of the lies from the reactionary Tea-Party people or most Republicans.

      The next layer in all of this is the wage differential between the two countries, Mexico and the US. Many US companies have maquiladoras close to the border. It’s no secret that these factories employ Mexicans at low pay, offering no benefits, cutting corners on safety, and demanding long hours.  Americans resent having lost their jobs to Mexico and other countries in this manner. So we have NAFTA – Free Trade for corporations, but if you and I try to bring commodities across the border, we would be answering a lot of questions by the authorities. There aren’t enough jobs to go around, though. And these corporations have no loyalty to any one country. They may be American companies by origin, but they only stay in the US for whatever profit there is in that. Besides, Congress hands out big checks to these corps. on a regular basis.

      So American standards are falling. The wages are falling, the standard of living is falling, everyone is anxious about the future, and this is fertile ground to forment racial tension. If however, everyone, and I DO mean everyone, stood unified against these mega-corporations and demanded wage equity regardless of where they opened a factory, they would have no place to run. They could no longer exploit the Mexicans and use that as a club to drive down wages in the US. I say, bring Mexican wages UP, bring standards in other countries UP so that NO ONE needs to suffer. No one needs to be the object of fear and hatred, violence and needless death. Stand together. Stand united.

These racist cops should go to jail or better yet, be put to death but we both know it won’t happen.  Just a year ago Detroit Police murdered a 7yr old African-American girl while she was sleeping in your bed. Another case of entering the wrong home. One of the cops through a flash grenade into the girls room which landed on her bed and set her on fire.  While the girl was burning the cop shot and killed her.  The police then arrested the girl’s grandmother and said the reason why the girl was shot was because the grandmother went after the cops gun. Bull Racist cops and guess what?  None of them have been charged.

            Oh yeah you always going to have that in Law Enforcement because it’s like they them selves say, They are Brothers in arms. We don’t have that much of a Department over here in Martin County. You hear lots of talk about things that Police do that is wrong but yet people want you to remorse over them. I can’t say I wish death on any of them because I don’t wish death on no one but their wrongs doings need to be uncovered and brought to light or they will just continue getting away with it. We have had our share over here Law Enforcement wise and when I was talking about Racism here I was speaking more about the people here, Well at least within the City. I recall this time when Law Enforcement was in this chase with this Guy for Kidnapping his Ex-Girlfriend and when they got him stop after he crashed into one of their Patrol Cars they just let their Dog attack him when they already had him down on the ground without force and when he reach for something to get the Dog off of him they shot and killed him on the spot, I see that as them setting him up to murder him. It gets even worst because when the Police Chief was confronted the only thing he had to say is… “My Officers was just doing their job” so that just goes to tell you what the job of a Cop is…. I didn’t say it the Police Chief said it out of his own mouth. All my remorse goes towards the “Real” Victims. Another case was when these Cops shot up this off duty Black Cop that they claimed they didn’t know was a Cop. I also recall many years ago my Uncle on my Mother’s side was beaten by this North Carolina State Trooper “Simply for driving a Cadillac” if though it was illegal for African Americans and Latinos as well as other people of color to own Cadillacs back in the 70s.

    Everyone involved in the raid, from the leader of the SWAT team, to the person behind the desk giving them orders should be criminally prosecuted.  It was inhuman how that whole operation was performed.  It is a shame that our tax dollars pay for their training, living and health care.  If this injustice operation goes unpunished,  it will once again prove that America is a prejudice country, that the phrase, “with liberty and justice for all…” is only for those holding the gun.

You’d think that before cops can get a warrant for a house and go in there, they’d have to know something about the people that live there. The fact that he was a Marine should have earned him a little more respect–No, I take that back–it should have earned him A LOT more respect than he was shown. If someone killed a dog that way, they’d go to jail. There’s no reason why anyone should feel free to treat a human as if what they did was okay.

Hell no!  I can give you cases where this stuff happened to successful African Americans in middle class neighborhoods. It’s racial profiling and I have relatives who have served as police officer from street cops all the way to captains in 2 states who talk about the racism in the police dept. and will Tell you without doubt Racial profiling is the norm!!

        I can’t even imagine the horror this family felt when this happened, and I am outraged as well. I want to know what the hell happened. Someone needs to pay for what happened, and be prosecuted, if deemed necessary(which it appears so!).

        The thing you have to remember is the amount of fear that most of law enforcement families face everyday when THEIR loved one leaves for work.
         Are they going to come home? Safe?
         I am in NO WAY making light of what happened, and/or making excuses for anyone.. but as a person who cares very much whether her friends are safe out there, trying to protect and serve in the RIGHT way, please take care in your comments. Thanks.

          There are much care in my comments, I don’t see in anyway where I was Stereotyping Law Enforcement “Especially” where you mention “All” because that’s exactly what Law Enforcement is all. I am posting not by what I have heard but yet what I have seen. Let’s think about these Officers known to some as “Good Cops”, What do you see them doing when their fellow Officers are bashing someone head in, Do you see them trying to stop them and arrest them?, No… You see them standing off to the side not wanting to get in on it because they already know that the Officers involved is in the wrong. No one even get shot “At” 71 times and Medical Care refused to them and have someone come up and talk about getting to some point as to “WHY” this has happen. The answer is looking you right in the face all the time. I know about this stuff I learned about Law Enforcement and was in both the Rescue and Police Explores back in the early 80s and know from seeing the dos and don’ts. Right now my care is with the victim because no matter how you cut it these Officers was totally in the wrong, DEAD WRONG. I have Family Friends that is in Law Enforcement and know very much about this stuff. An Officer already know the ropes of being a Cop, Not one of them on the entire force should be afraid to do what our Tax Dollars are paying them for (This not being one of them) but yet back in my own Hometown once when this fight broke out and many Cops was on the scene, They all ran instead of doing their jobs. It’s not like I’m trying to force these Officers to be in the wrong, They was already in the wrong therefore there’s no Stereotyping going on here on my side. Only if I was trying to force them to be in the wrong then and only then I would have been Stereotyping them. I’m just doing my job as a Human Rights Advocate and what I see here just is totally out of line which is a problem because if you go soft and think about these Cops side it only give them support to keep this type of thing up. It is Law Enforcement job to announce them selves “Before” busting in on someone and this is not what happen here which brings them down even harder because in my opinion the Marine had every right in the book to protect his self and Family, Anyone would do that when someone bust into their home unannounced including yourself. Of course everyone need to know why but come on they sit and “Allowed” this Man to die before his own Family without Medical Attention, There is no way I can go easy on someone like this and only allow it to happen again, That is unheard of. Not no 71 times. It don’t too much matter now the answer on the other side of that “WHY” you are speaking about this Man can’t come back no more this lifetime. Another fact is Law Enforcement they know whom is whom when it comes to Law Enforcement and Military so it’s no doubt in my mind that they knew that he was a Marine. They are the ones with the why questions pointed at them, “Why” did you do it.

    Wait, where does the racial profiling part come from?  Just the fact that he’s Latino?  I’m not trying to say that racism doesn’t exist, but there is absolutely nothing here to indicate that racial profiling was involved here.  In fact, it may be that one or even all the SWAT officers were Latino, though the latter possibility is not likely.  

    Don’t get me wrong, I’m no fan of the police.  I know they can be racist and can abuse their authority.  Further, I believe in a right to defend one’s home invaders, using deadly force if necessary.  It seems that the conduct of the SWAT team here was a condemnable abuse of authority that resulted in the death of an American hero.  However, before anyone makes the statement that this was “a pretty egregious case of . . . racial profiling,” there should be evidence to back that up.

      James, I think it’s a lot more complicated than that. Where were these cops when Jared Laughner was scaring the bejeebers out of the faculty at his community college? Threatening them? Where was the SWAT team there?  It’s the same state, same town, except one guy was minding his own business working in a mine and another was acting out crazy and making threats.  There’s a lot more at stake when the police get these warrants, especially in Arizona as we now know with Sheriff Arpaio’s office as an example.  Latinos are *automatic* suspects to the police in that state, it’s been documented both internally and externally from places like the  DOJ.  You don’t pull stuff like this if you can’t get away with it, and with what population can you get away with something like this?  That’s where I’m coming from, I am not just throwing out that stuff, does it make sense?

        the police should have stated who they were before ever stepping foot on his property..i am half white and half mexican myself if it wasnt for my family coming here and being who they were i would not be the strong 24 year old chicana single mother of 2 children that i am today all the latino people as a whole want to do it to work to provide for thier families where is the crime in that you have people who play the system thier whol lives and pass it on to thier children who are of other races shouldnt they be treating them the same way. thier is bad in every race but why are latinos being singled out???

        I understand there are problems with individuals from law enforcement agencies all over the country engaging in racist activities, and I don’t doubt there has been a problem with this specific agency.  However, the fact that the police didn’t arrest anyone when Loughner was threatening people is not indicative of racism.  He may have been acting out, but these cases are not comparable.  Further, although it didn’t involve PCSD, Nidal Malik Hasan, a non-white, Palestinian man, made many comments that may have indicated that he was a threat, but nothing was done.  He later killed 13 people himself.  I’m not trying to say that there isn’t any racism involved here.  I’m just trying to say that making the jump from the fact that police shot a Latino to the assumption that it was racially motivated with no other evidence supporting that assumption is irrational and dangerous.

        I’m not trying to defend the SWAT team’s actions here.  I am only trying to make sure that all conclusions made are arrived at with thoughtful deliberation and substance to back them up.  I hope you don’t take offense to any of these comments.  I just think it’s important to have evidence to back up accusations of racism or other malicious motives.

      Police dont accidently shoot no one and if they didnt have that badge they would get prosecuted just as any of us normal citizens. I hate police and this is one instance of why my friend was shot and killed on a mistaken idenity so therefore …. the police and there families i hate you all hope you all die slow in hell bastards

        I don’t doubt that police get away with crimes because they are police.  My comment was only meant to point out the fact that there is no evidence of a racial motive in this case.

      I think the racial profiling part comes from the fact that the police shot the man 71 times, that is a little more than using deadly force “if necessary.”  I understand the man came out with a gun, however the police should have gave some sort of warning or notice that they were police when they saw a gun rather than just unloading 71 rounds into his body.  What did they think would happen just showing up at a marines home with a whole team holding guns, grabbing his gun was just a trained reaction.

        There is no evidence of racial profiling.  None.  You have cited evidence of other illegal and improper activity by the police that resulted in the death of a U.S. war veteran, but you cite nothing that even implies the possibility of a racial motive.

    People say cops have the right defend themselves, and its true but this is totally on overkill, 71 times WTF. It happens alot even if the guy had been the one to shoot first, the SWAT team already have the advantage in numbers, I bet they heard a shot and each one of them started shooting blindly probably didn’t even know where the shot came from. I’m guess 3-4 man swat team minimum, each with an semi-automatic, automatic weapon or shotgun, all start shooting at the same time yeah, thats an overkill.

      You all don’t know the details of the raid and the entire story. Yes, 70+ shots seems way overboard and denying him medical attention is completely wrong; however, that’s all we know. This man may have been a gang member, regardless if he served overseas, he may have committed gang crimes, murder, etc…b/c just as there are crooked Cops, there are also crooked soldiers. You should be focusing on the fact that someone was denied medical attention after being shot and wait for the rest of the details to emerge. I guarantee that if this soldier had brutally raped a woman or child, your comments would change drastically.
