Phase 1 in the battle over Obama’s immigration actions could reach the Supreme Court in weeks

*Follow me on this: A federal judge in Texas temporarily halted President Obama’s immigration executive action. The administration has now filed for an emergency stay to stop the judge’s ruling. So all the bickering, accusations and speculation about pushing immigration reform forward, at least one temporary step, will be resolved soon in the highest court in the land. This is going to be a very interesting spring and summer. VL

The Obama administration filed in federal court Monday for an “emergency” stay of a federal judge’s ruling, so that it can continue to implement the president’s executive actions on immigration while a lawsuit against them works its way through the courts.

This is a relatively aggressive move by the administration. The court battle over the president’s executive actions will still take a long time, but the stay means that the next phase will happen very quickly.

The judge who initially ruled against the administration, Judge Hanen, will now have to consider the stay. If he rejects it, the government will take it to the 5th Circuit Court of Appeals. Those rulings could come within days of the filing, but will likely take a few weeks.
