Texas withholding birth certificates of citizens born to immigrant parents

The complaint alleges that the Texas Department of State Health Services is denying the certificates to the undocumented parents of citizen babies. Six Rio Grande Valley immigrant mothers filed a lawsuit accusing the state of refusing to issue their U.S. born children birth certificates.

The lawsuit filed Tuesday in U.S. District Court for the Western District of Texas, located in Austin, names the Texas Department of State Health Services’ Vital Statistics Unit in the case.

“We are making it impossible for these women to get the legal proof they need to take care of their children, and we are denying U.S. citizen, Texas born children their basic rights,” said Jennifer Harbury, an attorney with Texas Rio Grande Legal Aid.

Harbury represents the six U.S. born children who cannot obtain their birth certificates.
